Terms of Service

1. Acceptance of Terms

By accessing or using the Venom platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

Venom provides a content protection platform that includes invisible watermarking, distribution tracking, leak detection, adversarial AI poisoning, and related services accessible through a web interface and API.

3. Account Registration

• You must provide accurate, complete registration information
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the Service
• You are responsible for all activity under your account
• Notify us immediately of any unauthorized account access

4. Your Content

You retain all ownership rights to the content you upload to Venom. By uploading content, you grant us a limited license solely to provide the Service — specifically to process, watermark, store, and distribute your content as you direct. We do not:

• Claim ownership of your content
• Use your content for training AI models
• Share your content with third parties except as you direct
• Access your content except as necessary to provide the Service

5. Acceptable Use

You agree not to:

• Upload content you do not have rights to protect
• Use the Service to infringe on others' intellectual property rights
• Upload illegal, harmful, or objectionable content
• Attempt to circumvent rate limits, access controls, or security measures
• Reverse engineer watermarking or fingerprinting algorithms
• Resell or redistribute the Service without authorization

6. Watermarking & Protection Services

Venom embeds invisible watermarks in your content as directed. While our watermarks are designed to survive common transformations (compression, re-encoding, format conversion), no watermarking system is completely tamper-proof. We provide tools for generating evidence and reports, but we do not provide legal advice or guarantee outcomes in legal proceedings. The verification and evidence tools are provided "as is" and should be used in conjunction with qualified legal counsel.

7. Distribution Services

When you use Venom's distribution features, we create uniquely watermarked copies for each recipient you specify. You are responsible for ensuring you have the right to distribute the content and that the distribution complies with applicable laws. Distribution records, access logs, and recipient information are maintained for your reference and for leak attribution purposes.

8. API Usage

Access to the Venom API is subject to the rate limits and quotas of your subscription plan. You are responsible for securing your API keys and bearer tokens. We reserve the right to throttle or suspend API access if we detect abuse, excessive usage beyond plan limits, or behavior that threatens platform stability.

9. Payment & Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Overage charges for usage beyond plan limits are billed at the end of each billing period at the published overage rates. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.

10. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees. Upon termination, we will delete your data within 30 days, except where required by law to retain it.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WATERMARKING AND PROTECTION TECHNOLOGIES ARE PROVIDED ON A BEST-EFFORT BASIS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VENOM'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL VENOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Venom from any claims, damages, or expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of any third party rights.

14. Dispute Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the matter informally for at least 30 days. If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.

15. Changes to These Terms

We may modify these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
